How can the economics toolbox help to overcome some of the challenges?
To date, there have been a limited number of successful damages claims in the area of state aid. Indeed, a study for the European Commission in 2019 highlighted that national courts have awarded damages due to the harm caused by unlawful state aid in only 1% of cases. The main reasons for the low number of successful state aid damages claims include difficulties faced by national courts in assessing the existence of aid, as well as the high burden of proof on the claimant in terms of being able to demonstrate that the unlawful aid caused the damages. This article discusses how economic and financial techniques that are now standard in follow-on antitrust damages cases could be used to assist the quantification of damages in the state aid context.
