1. A jurisdiction far, far away
The EU legislator is currently discussing new legislative proposals to improve cross-border acess to electronic evidence. This article provides an overview of the reasons behind the proposals and an outline of the changes they would bring if and once adopted.
First, why do we need these proposals? They seek to address a unique challenge that law enforcement and the judiciary face when dealing with crimes committed through or with the help of digital means. Criminals use the internet in many ways: to launch a cyber attack, to trade images of child sexual abuse; they purchase weapons or drugs online; they use communications tools to prepare and coordinate criminal activities in the ‘offline’, real world. At each step, they may leave digital traces – an IP address, a login name and time, or even the content of a message – collectively referred to as ‘electronic evidence’ here.
